How has Obama done so far in putting together his cabinet and security team? He has taken a moderate path which I applaud. He kept Gates and appointed Hillary and Bill Richardson. He is showing that he can go towards the middle. He is not the modern day Che Guevara that some of the right leaners might portray him to be. He does have some Clinton folk in there, but overall I think his choices have been far more eclectic than the Bush team was. Should be were not was. Darn it.

As you will remember, in 2004, Bernard Kerik was George Bush's first choice to be the Homeland Security Director. Homeland Security director is a cabinet-level position in charge of some of the most sensitive and important work in the US government. Do you think that Bush used good judgement when tapped this criminal for such an important job? Is it bad judgement to at least make sure the guy is clean before you nominate him? And Kerik withdrew his nomination, he was not asked to step aside, unless Bush is a liar.

As a landlord..what would make you keep any of the security deposit? I'll be moving out of my apt of 4 yrs. and the landlord is very mean and picky..he and his wife are complaining about 2 small stains on the rug and "grease" on the cabinets..which you can't see with the naked eye! Last time about 3 or 4 disappeared from their rooms because it was stolen. Some were real good games. My mom have a file cabinet to put their video games in there. But somehow, someone jamed the file cabinet lock and caused each game stolen. My mom thinks that it must be someone who is not living in my home. Now, my brother's GameCube wireless controller is gone the file cabinet lock is useless. Security Deposit Problem - Do we have grounds for small claims/fighting it? My former roommates and I just received our security deposit checks back from the apartment we lived in for the past two years, and we've got huge problems. The apartment was off-campus and the landlords have a rather bad reputation for treating tenants poorly (something we didn't know at the time we signed the least 3 years ago...) During the time we lived there, numerous complaints for problems such as lack of heat in the winter and several other issues went ignored. At one point they sent a guy to look at the thermostat, who declared that we had broken it. He never came back to fix it, despite promising to return within a day or two, and we continued to go without heat for most of the winter. We were all determined to get our security deposits back in full upon moving out, so we spent THREE days doing nothing but cleaning the apartment spotlessly. Two parents, my mother and one of the other girls' mother, helped us clean and we even took pictures. We went above and beyond in our cleaning--baseboards, scrubbing out cabinets, mopping, vacuuming, cleaning the walls, etc. It looked far better when we moved out than it did when we moved in. And yet, today we get our checks for less than half of what we paid in security deposit. The deductions they state are for repainting the walls and cleaning services come to $600. (Each of us paid a $450 security deposit.) I've done some research for New York state tenant's rights and the laws regarding security deposits, and from what I've read it seems that a landlord can only deduct for repairs beyond normal wear and tear. And according to this page: http://www.rentlaw.com/normalweartear.htm repainting does not constitute as "beyond normal wear and tear". Now, if we cleaned spotlessly, have pictures of the fact that are dated, do you think we have a case to ask them for the rest of the deposit? I honestly think we do, and after the treatment we got from them coupled with the fact that we were very good tenants, I'm so beyond angry that they withheld so much.
Can I keep security deposit because of curry smell? I live in North Carolina and recently had a tenant move out that obviously cooked with curry and other Indian spices fairly often (not to mention they didn't clean very much either). They lived there for over 2 years and now I am faced with trying to remove this odor from the dwelling. It has infiltrated almost everything; carpets, walls, even the wood cabinets (which are also stained too). My wife has spent hours scrubbing the cabinet doors with "murphy oil" and "goo gone" and it isn't helping much.... can I keep their security deposit (1.5 month rent, over $1500) to address this issue? We may have to remove all the cabinets and counter tops (which are stained and ruined too) I am really only looking at the kitchen damage, the countertops and cabinets alone will easily eat up what is left of the deposit. They already are getting dinged for not doing move out cleaning. My dwelling is a higher end rental, so given the current look and smell of the kitchen, it will be impossible to rent... I think a judge would sympathize with that.

security deposit question? My wife and I recently bought a house and moved out of a house we were renting, we were there for 3 years exactly. We paid a $525 security deposit when we moved in. Our landlord was a pretty absentee landlord in 3 years he never came to house once to check on it or anything, if anything broke he told me to fix it and take it off the rent which I was OK with since I was quite handy and it lowered the rent. About a month before we moved out our furnace, which was an oil furnace, started spewing out black soot. It was at the beginning of the cold season and we just turned our furnace on so I thought it might have just been gunk getting thrown out of the system. I changed the furnace filter, scrubbed the soot off the walls and waited a few days. Nothing improved the house was starting to get covered in soot. I emailed him and told him of the problem about 5 days after we first noticed the soot starting to cover the walls. He sent out someone to clean the furnace and the repair man told us that he usually does all the work on that house for the landlord and that he hasn't cleaned or service the house in years, we were there for 3 years and never once was the furnaced serviced or looked at. He said that the chimney was completely clogged and he would do what he could but come spring time the landlord would have to have a complete overhaul of the heating system done. He vaccuumed out what soot he could from the chimney and said it should get us through the winter. I continued to change the filter almost weekly but the soot kept coming back, we scrubbed it ourselves 2 times but we couldn't get all of it out of the carpet or off the walls and cabinets. When we moved out I got a rubscrubber from my parents and scrubbed the carpets but you could still see the soot. He told me to leave the heater on after we left so that the pipes didn't freeze, he didn't get to the house until about a week or so after we moved out to check it out so the heater and the soot were blowing constantly for that week. 28 days after we moved out I received a letter from my landlord that he wanted to keep our $525 and wanted an additional $830 for scrubbing the carpets, cleaning the cabinets, servicing the heater and replacing ductwork. I don't feel that I owe him the extra money, there were a few little things that he can probably get the $525 out of so I don't care about getting that back but the additional $830 for the heater issues I don't feel is my responsibility, He said that the system was completly blocked and that the problem happened over a long time and I never told him about it. I told him 5 days after we first noticed it. I waited because I wanted to change the filter and see if it was just because we just turned the heat on for the first time. The heater was never serviced while we were living there in 3 years and I don't know how long before that. Am I responsible for the damages that were caused by the heater since maintaining the heater is not my responsibility.
Can you paint the kitchen cabinets in a rental house? I live in a shabby, not so great apartment in a crappy part of town. The apartment community is all owned by one company, not like individual landlords for each unit. Whenever someone moves out they just paint everything white (very messily). So many layers have been painted that it is puckering and peeling off. Yuck. I know I'm not allowed to paint the walls though. However, the kitchen cabinets are an awful, dark colored wood that is very old and somewhat faded. There are random white paint splatters on them from when the spray paint the whole house or whatever. It looks terrible and is depressing but I can't afford to move right now. Would I be able to paint these cabinets as a renter? I would ask the company but they are impossible to get through to. What's the worst that would happen...? I wouldn't get my security deposit back? Help.
Security deposit for repairs? My husband and I just moved out of a rented trailer and have moved to a rented apartment. The landlord kept the security deposit and the pet deposit which was fine with us because there were scratches in the spare bedroom that the were ALREADY there when we moved in, but that our cats did make worse. So anyway we paid him half the rent for the month since we left on the 15th and were not under a lease. During our 18 month stay at this trailer we dealt constantly with mold and many other problems. We would tell him about mold in the bathroom, he would spray it with bleach, paint it over and then it would go on to reappear in the 2nd bathroom, then the kitchen, then the closets, He claimed it was"normal" for a trailer to have mold and that it wasn't alive. Although I don't know how it could be "Dead" if it was growing everywhere. When we moved out we found it under the kitchen sink, in the other closet, in the cabinets. We also could hear a water leak under the trailer , which had happened before and had created mold under the trailer.I developed asthma while living in the trailer and so did my husband. My question is do we owe money for the repairs? The landlord says even though he kept both deposits that we still owe for repairs? Should I offer to go sand it and plaster it and paint it? I am at a loss here. (Suing him for anything in not an option his mother is my boss at work and I fear that she would find a reason to fire me)
Texas tenants law - landlord withholding security deposit with no notice of charges? I am a Texas tenant - I just moved out of a rental property we lived in for 3 years. I had the unit professionally cleaned (walls, baseboards, cabinets, etc). I also cleaned the stove and refrigerator thoroughly myself. There were a few things I was expecting to be taken out of the security deposit. We did not replace the light bulbs and there was a small hole in one of the rooms (which we patched ourselves). It has been 38 days since we gave the keys to the landlord and gave him our forwarding address. He has ignored my requests for the security deposit refund or explanation of charges and when I finally got ahold of him, he said he spent $3000 repairing the property (the deposit amount was $1000). I told him I had a right to the charges, he said he'd have the maintenance guy "put something together". He said they had to re-drywall in multiple places and re-paint the inside of the whole house. (I have no idea what that would be for). Aside from the things I mentioned earlier, the house was in better condition than when we got it. I've read the TX landlord tenant law, and it looks like I can sue him for 3 times the security deposit, plus court costs. My problem is that I did not take any photos of the unit (I know, I know, that was REALLY dumb - never again). Any advice? The law makes it sound like he completely forfeited his right to the deposit when he did not send a list of charges or refund within 30 days. My concern is that the maintenance guy will exaggerate charges and I don't have photos to prove it in court. I think I will pursue the suit unless he'll refund me the amount of the deposit outside of court. Any idea what he would need to prove damages if he did counter sue? I'm sure all he would have is the word of the maintenance guy, since there was not actually damage other than the aforementioned items. Also, are light bulbs really considered normal wear and tear? It makes sense now that you say it, but I definitely thought that was a tenant responsibility.

Social Security Disability Help? I am so confused and I need some advice. I am a 40 yr. old female and I have several health issues. I suffer with Severe Depression, Panic Attacks, Migraines, Degenerative Disc Disease, Rheumatoid Arthritis and have "inherited" Hearing Loss which has gotten worse in the last few years. Out of desperation last September I had a discectomy at C5-6 (neck). I had lost use of my right arm due to nerve impingement plus I couldn't stand the pain any longer, the disc had wore out. The disc was replaced with a plate and screws, the bone spurs cleaned up. Now here I am a year later and I literally have to "crawl" out of the bed in the mornings to go to work. I have tried everything from excercise, massages, alternative therapy and nothing helps. I have to FORCE myself to function daily and then sometimes I still can't function, I either have to lay on a heating pad or walk the floors. When I go to work the only thing I can focus on is getting home and trying to alleviate the pain in my arm, neck and back. I get so stressed out from these feelings it sets off the panic attacks and migraines. I work in the automotive industry which is stressful in itself and it also demands alot of repetitive body movement and requires practically standing in one spot for 10 to 11 hours a day. I have no social life, I try not to complain to my husband and friends because I know they are sick of hearing me talk about how bad I hurt. I have regular visits with my family Dr and a Rheumatologist, my cabinets are stockpiled with medicines (right now I'm on Hydrocodone, Ambien CR, Skelaxtin and Lexapro). I'm so tired of feeling like this all the time, I stay depressed because of pain and missing the things I use to do. I often have thoughts of wishing that I would die. Some people have suggested that I try to file for Social Security Disability. I went to work when I was 15 years old and I have worked all of my life and I'm scared of what a transition like this entails. What are my chances of being approved be? I would like to hear from others.
Laws regarding a business storing social security numbers? The business I work for requires time cards to contain social security numbers. After hours, time cards can be slid through mail slot, where they lay on the floor for all to see. Since the door/windows are glass... the public can peek in and try to view this info (depending on if the time card falls face up/down). Each employee hand writes all their info, so sometimes, it is in quite large print. The central office also has a lot of foot traffic and all time cards, physical employee files, etc. are not locked up. Often, they are laying out in the open. Anyone walking in can peek at this info while speaking with the staff. Are there any laws regarding employee privacy and social security laws? The root cause is the owner, who refuses to change practices or provide locking filing cabinets (or even sufficient non-locking storage areas).
How to deal with a security deposit 2 years into SF,CA lease? My partner and I have unusual situation with our living in the building where she was the property manager and terminated wrongfully. We've had a lease that was a year then after 2007 month to month. During the years she worked the security deposit was not a problem since we were struggling and just were left with a "pay when you can". Her leaving the job wasn't pleasant and we are sticking it out only until she can find another job.Which although collecting unemployment we lost the discount for managers and its making the mountain climb harder! My point is the hostility from the landlord to get us out has given us 10 days to pay the $1150 security deposit. I know the lease says we owe this and even angry I know we were ridiculous not to deal with it or foresee consequences in the future. I know we'll be in breach of the lease (which is exactly what they want) so i don't want answers to how to not pay it. we owe it. But what i do have concerns with is there wasn't a normal walk through in the beginning since we literally built the apartment and installed the plumbing,electricity,drywall,and cabinets to make it an apartment.And if i'm going to pay this deposit within ten days, what can i do to ensure we'll get it back. I had lived a townhouse in CA more than 6 years. I moved out a few weeks ago, and look! what my landlord said to me. We( I live with my family and pets) damaged the carpet, damaged one of the cabinets and so on... And the money she wants me to pay is more than $6,500. What I really don't understand is she is trying to charge me whole carpeting replacement fee. I want to be honest with you. My pets often threw up so there were some stains on the carpet. The downstairs carpet didn't look clean. There are a lot of things she wants me to take responsibilities. I want to be honest and don't want to cheat. So, some of them, I agree to pay(of course to pay means to use my security deposit) such as a cleaning fee, to fix some damaged parts. But definitely not all of them, Is there a good site I can take a look? Are there laws that can protect me? One more important thing. She is re-modeling her property before she looks for a new tenant. More money she can get from me, the less money she will spend on the re-modeling.

When I go to work the only thing I can focus on is getting home and trying to alleviate the pain in my arm, neck and back. I get so stressed out from these feelings it sets off the panic attacks and migraines. I work in the automotive industry which is stressful in itself and it also demands alot of repetitive body movement and requires practically standing in one spot for 10 to 11 hours a day. I have no social life, I try not to complain to my husband and friends because I know they are sick of hearing me talk about how bad I hurt. I have regular visits with my family Dr and a Rheumatologist, my cabinets are stockpiled with medicines (right now I'm on Hydrocodone, Ambien CR, Skelaxtin and Lexapro). I'm so tired of feeling like this all the time, I stay depressed because of pain and missing the things I use to do. I often have thoughts of wishing that I would die. Some people have suggested that I try to file for Social Security Disability. I went to work when I was 15 years old and I have worked all of my life and I'm scared of a transition like this entails. What are my chances of being approved be? I would like to hear from others.
Can I sue my former landlord for not returning my security deposit? My wife and I moved out January 6th, 2010. We did not receive a check for the deposit until mid February and it was for $100 less than the security deposit. I called the manager and he stated that it was for cleaning purposes. I asked for an itemized list stating the deductions as we did not receive one with the check. The unit we rented was not clean and I had to do a lot of work when moving in. Putting vinyl paper in cabinets all the cabinets and general clean up. We continually had problems with plumbing that were not addressed and I ended up fixing them. Also our fridge gasket was bad, the manger broght one over which I had to install, but was the wrong size so I had to install the old one and add tape to it would seal properly. When we moved out it was in much better condition than we got it. I believe it was Feb 15 when we received the check and was a personal check from the owner but no itemized list was attached. I called the manager, who took over the property on December 1 but we were not even informed until a week later, and he said he would mail out the list. So far I haven't received anything. Is it safe to just start the paperwork for the lawsuit at a small claims court? I still haven't cashed the check that was sent out. I know it's just $100 dollars but that's money we could use and if it was the opposite I'm sure they wouldn't accept me taking off $100 from the rent. We have pleanty of before and after pictures. After leaving one of our former neighbors said the owner has had problems for holding people's security deposits in the past. I'm more interested in sending a message to the landlord than anything else. But with a baby on the way the 100 bucks won't hurt. Could penalties and interests be added by the judge?
What am I entitled to deduct from the security deposit and how much? Here is my situation- I would really appreciate some advice. I am a first time landlord on a 2 story, 3 bedroom/2.5 bathroom condo, approximately 1400 square feet. Our tenants just finished their 1 year lease this week and I have 21 days under CA law to return the deposit. There are some issues however and I am wondering what I am entitled to deduct from her $1000 security deposit and for how much for each issue? 1) Downstairs wood laminate flooring - not cleaned 2) Missing mailbox key (spoke to post office and they said it would be $50 to redo the locks) 3) Inside of oven did not seem to be cleaned 4) Sub par paint work - paint on door frames, baseboards, etc... (her family owns a handyman business and we allowed her to repaint all our walls & ceiling with materials we provided for $1000 deduction from her initial rent payment- but we never saw the finished work til now after they have moved out. They did a pretty poor job. Doors & baseboards were not included but it looks like they did not tape up upstairs so there is peach paint around the door frames & baseboards and uneven paint coverage on the walls) 5) Missing patio furniture (1 round glass table + 4 plastic chairs - I probably paid about $50 for the set when I bought it new) 6) Missing storage cabinets (Probably paid $50 for them new) 7) Missing floor lamp (Probably paid $15 for it new) I informed her of the missing items and she said her family may have just taken everything while moving unknowingly and if she locates them, she will return them by placing them on our back patio (open side gate). How long should I give her to return these items? The last issue is that in the last 6 months, her rent has been late 5 of those months. I have never collected the late fees from her although in the lease agreement it states that every day it is late is $10. For November, she moved out on the 10th. Rent is due on the 1st, late fees are supposed to commence on the 6th. It is now the 14th and still no rent check has been received. I asked her again about this last payment and she states her father definitely sent the check on the 5th (which would still mean her payment would have arrived late). If I didn't receive the check in the mail by today, they would have to put a stop payment on the check and send me a new one. She seems to think she is not responsible if her check is lost in the mail. What am I entitled to collect on late fees? Can they be deducted from the security deposit? For future reference, once we get new tenants in the condo, how should I deal with late fees? How should I keep proof of late arrival dates? Being a landlord can be such a pain in the butt. :( I would hire a property management company if I had more than one rental but after this first year's experience, I'm not sure I want to deal with the headache of additional tenants. Although I did come a week prior to move-out to try and show the unit to a prospective tenant and the place was in complete disarray due to her being in the middle of packing. She refused me entry during the month of October which certainly hindered my ability to try and find new tenants in a timely manner as well. In hindsight, I was too nice and accommodating during the lease period. I should have insisted on inspecting the paint job. We came a month later for a work receipt for tax reasons and it still was not finished and I gave them the benefit of the doubt that it would be fine.They promised an awesome job since they wanted to make sure the placed looked nice since they were living in it. Apparently, she was unhappy with the color I chose which she brought up today during our phone conversation and then hung up on me. Rude
Was my landlord being a jerk or did he have the right to keep my security deposit? My landlord gave me and my 3 teens 2 months notice to find a new place because he said he was selling the house. He wasn't please with the paint in different rooms but he said to leave it and he would be painting anyhow. Other than that, I made any repairs needed. The rest seemed like wear and tear. He hadn't made a repair in 5 years or any other changes to the house. He had put a wood tile floor in the kitchen - water leaked from the tub upstairs down through the ceiling (the ceiling had to be repaired before for this) and it ruined a few tiles on the floor. And when I pulled out my fridge, one of the tiles there kind of crumbled. But first he lied and said I didn't give him a security deposit. Then when he asked for the last months rent, I told him to take it out of the security deposit - he said "Im my lease it says you can't take the rent out of the security deposit" ....but I thought there wasn't a security deposit, you liar?? So he was being a d**k. I got mad, swore and left and didn't give my forwarding address. I was afraid he might say bad things about me to my new landlord. I am worried about what is going to happen or should I have given it to him. I think he's going to lie and make up $650 worth of expenses. What should I do please? Also - I am on section 8 - there has been an inspection every year which had to pass - this summer because I moved, there wasn't one done. Is a $600 charge for painting out of a security deposit reasonable? I just ended a one year lease on an apartment. My security deposit was $1220. I received $395 back from the landlord. He had included charges for cleaning (even though I spent an entire weekend thoroughly washing everything - cabinets, walls, bathroom, etc.) but the largest charge was $600 for repainting the entire apartment. He charged me cost, and included the painting company's bill. I had only hung a few pictures in the bedroom and dining rooms, and had spackled the holes. I assumed a small amount of painting would need to be done to cover these holes, but instead they repainted the entire apartment again. This seems to fall more along the lines of reasonable wear and tear. Should I try to go to small claims court for part of this amount? The landlord seems unwilling to budge so far. I have pictures to back up my claims. I live in Missouri. We did a "walk through", but it consisted of me handing over the keys, and him glancing in the rooms to make sure they were empty.
Odds of small claims court ruling in our favor for security deposit return? I was renting a home with 3 other college students in Irvine, California for the past 21 months, and have been charged for some outrageous and ridiculous things out of our $3,200 security deposit. The list is as follows: 1)$400 for cleaning (not a very big house with only 3bd/2ba and not extremely dirty or uninhabitable by any means) 2) $298 for "miscellaneous repairs" (i.e. tightening door handles and kitchen cabinets, replacing light bulbs, replacing outlet covers, etc. etc.) which supposedly took 5 hours of labor to do at $49/hr. 3)$1,250 out of $2,500 for a repaint of the entire interior, because supposedly, the paint on a rental unit only has a 4 year life-span so we are responsible for the time we lived there out of 4 years. Also, it is not stated in our written and signed leasing agreement anywhere that this is a stipulation of renting the unit and we would be responsible for painting the home. We tried to communicate with the property management company through email and phone calls regarding our dissatisfaction with their deductions (especially the paint costs and "miscellaneous repairs" only to result in no response from them. We have decided to file a small claims law suit and have started the process by sending them a certified letter outlining our demands and telling them the reasons we're unsatisfied. We are completely being taken advantage of, and I would like to know what our chances are of getting the money from the "miscellaneous repairs" and the paint job back through small claims court. We only lived there for 21 months (almost 2 years) and are being charged for half of the $2,500 paint job (so $1,250 total) on that basis. Either way, I'm thinking it's completely unfair.

Social Security will start paying out more in benefits than it collects in taxes in 2016, a year sooner than projected last year, and the giant trust fund will be depleted by 2037, four years sooner, trustees reported. Medicare is in even worse shape. The trustees said the program for hospital expenses will pay out more in benefits than it collects this year, just as it did for the first time in 2008. The trustees project that the Medicare fund will be depleted by 2017, two years earlier than the date projected in last year's report. The trust funds -- which exist in paper form in a filing cabinet in Parkersburg, W.Va. -- are bonds that are backed by the government's "full faith and credit" but not by any actual assets. That money has been spent over the years to fund other parts of government. To redeem the trust fund bonds, the government would have to borrow in public debt markets or raise taxes. Treasury Secretary Timothy Geithner, the head of the trustees group, said the new reports were a reminder that "the longer we wait to address the long-term solvency of Medicare and Social Security, the sooner those challenges will be upon us and the harder the options will be." Geithner said that President Barack Obama was committed to working with Congress to find ways to control runaway growth in both public and private health care expenditures, noting the promise Monday by major health care providers to trim costs by $2 trillion over the next decade. However, Republicans pointed to the newly dire assessments as evidence the Obama administration has failed to come forward with actual entitlement reform to close the funding gaps. "Instead of getting existing public programs in order right now, some are saying we should create a new government-run health insurance plan," Sen. Chuck Grassley, the top Republican on the Finance Committee, said in a reference to the administration's health care proposals. "When we can't afford the public health plan we have already, does it make sense to add more?" House Republican leader John Boehner said the trustees report "confirms what we already knew: Our nation cannot afford to continue this reckless borrowing and spending spree." The findings in the trustees report, the annual checkup given the two benefit programs, did not come as a surprise. Private economists had been predicting that the dates the programs would begin to pay out more than they take in and the dates the trust funds would be insolvent would occur sooner given the economic recession. The deep recession, the worst the country has endured in decades, has resulted in a loss of 5.7 million jobs since it began in December 2007. The unemployment rate hit a 25-year high of 8.9 percent in April. Fewer people working means less being paid into the trust funds for Social Security and Medicare. The Congressional Budget Office recently projected that Social Security will collect just $3 billion more in 2010 than it will pay out in benefits. A year ago, the CBO had projected that Social Security would have a much higher $86 billion cash surplus for the 2010 budget year, which begins Oct. 1. The trustees report projected that Social Security's annual surpluses would "fall sharply this year," then remain at a reduced level in 2010 and be lower in the following years than last year's projections. The report said that the Social Security annual surplus would be eliminated entirely in 2016, reflecting increased demands from the wave of 78 million baby boomers retiring. That means Social Security will have to turn to its trust fund to make up the difference between Social Security taxes and the benefits being paid out beginning in 2016. The trustees projected the trust fund would be depleted in 2037, four years earlier than the 2041 date in last year's report. At that point, the annual Social Security taxes collected would be enough to pay for three-fourths of current benefits through 2083. Security Deposits? My current landlord is trying to keep the deposit even though his place is nicer now than when he rented it to us. He seems to think the security deposit was free money. The house is very clean and we fixed it for him just as he asked us to do. Replaced the broken cabinet doors, replaced the carpet (very expensive), sanded the floors and finished them, all professionally. We also painted the fence and painted the house... all out of our own pocket. He says the carpet in one of the rooms is bad and he's going to use the security deposit to pay for new carpet. It's not that bad at all though, and I know he has no plans to actually replace it. Even so, after 6 years living there, isn't it considered normal wear and tear? Under what circumstances can a landlord keep the security deposit? Is it really up to his discretion alone? How can I dispute it, only court? The house is about 70 years old, and the carpet was from the 1970s. It was authentic shag and already in really bad condition. Sadly, I don't think we have before and after photos. The date I vacated was on 12/9. My rent was roughly $23 a day ($700/mo) So basically I owed 9 days rent. My deposit was for $350. My landlord is trying to keep my WHOLE deposit, AND charge me another $357. What should I do? Can they keep the whole deposit and charge me more? Moving out soon, should I be worried? I've been living in a apartment complex for the past year and a half. We're moving out soon, and I didn't have to put a security deposit down. Can my landlord keep my security deposit for damages I did not do?? Help! I am in a mess. My old landlord claims I left the apartment a mess...I live in Tennessee...I had a 350 deposit and they claim damages came to 469 dollars. California Tenant/Landlord Security Deposit Issue? Hi! I need some help. I have lived in my apartment for almost 3 years in Sherman Oaks. Halfway through the that time, the building was sold to another real estate company. We are now moving out. The new landlord has the copy of our lease, but does not have the initial move in checklist that we filled out when we first moved in. The carpets were not new and some what worn. What is the best (cheap) way to contest charges against my security deposit? Upon moving out of my apartment I received a check for $32.00 (that's all that was left of my $400.00 security deposit after 'additional charges'). The rental company claims that it costs: $38.00 for drywall damage (nails in walls for pictures) $144.00 for removal of plastic toddler locks on cabinet doors $186 for additional paint (the holes?) Can I take exterminator fees from a tenant's security deposit? I have rented for a year to a single mother with 5 kids from 20 years to 1 year old. Three months after they moved in, the house was full of bedbugs and roaches. The house has been in my family for 60 years, and there was never a bedbug or roach in all of that time. After the last owner (my aunt) passed away, the house was vacant for 2 years before I bought it and reonvated. I put in new carpets, cabinets and paint before renting the house. I paid for an exterminator once, but 3 months later the bugs were back. Do I have to keep paying for her bugs? She insists that they are 'coming up from the damp basement'. I've never heard of bedbugs living in a damp basement where there are no human beings to bite. To be fair to the tenant, bedbugs don't come from a dirty house, they are carried in on the actual bodies of the people they are biting. They also can be transferred in mattresses, furniture or clothing that is brought into the house, and they can hibernate for up to 5 months waiting for their next victim. The house was vacant for 2 years before I bought it, and was rented UNFURNISHED, so there were no existing bedbugs. There are roaches in the tenant's kitchen and on the enclosed porch. The kitchen looks tidy enough, but I don't know if she is careful about crumbs and scraps. There are no roaches in the basement at all (the basement is locked and is not part of the tenant's apartment) , and there never have been any. The furnaces and water heaters are down there, so I do go into the basement often.

We had a government oversight committee to watch Fannie and Freddie but they argued against increased regulation while they were sleeping with the executives and taking huge campaign donations from them. Why the Bush Administration allows illegal immigration? The US runs on capitalism (profits). And even though the Federal Immigration and Nationality Act Section 8 says it’s a felony to assist, shelter, or employ an illegal alien, President Bush won’t raise a finger because small and large businesses love illegal immigrants for cheap labor, and republicans stand for big business. Just look around your own town and see how many local businesses use illegal aliens for cheap labor. And because so many Americans are profiting from cheap labor, the public outcry is diminished and ignored in Washington. Large corporations love the cheap labor that illegal immigrants provide. They also love the thousands of annual H1-B visa immigrants that come to live in the US for skilled cheap labor. Small and large corporations despise hiring legal American citizens due to cost, plus illegal aliens work harder for less. In addition, big cities that invite illegal aliens have democratic mayors (New Haven, Chicago, San Francisco). These mayors hope to win the illegal immigrants future votes, once they become citizens, since most immigrants (about 80%) vote for democrats. But Bush has bigger plans to perpetuate an endless supply of cheap labor into this country for his corporate buddies by creating a NAU (North American Union) comprised of Mexico, US, and Canada by trying to pass the SPP (security and prosperity partnership) 413 amendment which Bush tried to sneak into his amnesty bill (Immigration Reform Act S.1639). Bush also tried to allow Mexican truckers easy access into the US but that also was defeated- for now. And Bush gave the green light to US Texas attorney Johnny Sutton (he works for Bush) to bring charges against two border guards for shooting a Mexican drug trafficker in order to intimidate US border guards and send a message to illegal aliens to keep on crossing. And because of the reasons stated above, I do not see any sign that President Bush’s cabinet or congress will take any major steps to thwart illegal immigration or enforce current immigration laws because the profits are too great as are the millions of future votes, even at the expense of the majority of Americans who oppose illegal immigration. There was never any attempt to "rid" the area of what few Arabs there were, or those Arabs that immigrated into this area along with the Jews. This contrasts with the actions of the governments of Morocco, Egypt, Iran (then Persia), Iraq, Saudi Arabia, Lebanon Syria & Yemen, who caused thousands of Jewish people to flee the homes that had been lived in by their families for generations. They ended up in pre-State 'Palestine'. (Even a cursory glance at the general Jewish population of Israel today, reveals a majority of dark-skinned Israelis, bearing testimony to their Middle-Eastern roots). From 1517-1917 Turkey's Ottoman Empire controlled a vast Arab Empire. Prior to World War I (1914 - 1918), the area now referred to as Israel, Jordan, Syria and Lebanon, were part of this Empire. During World War I, the Turks were allied with Germany, and when Germany was defeated, so were the Turks. So the four Principal Allied Powers of World War I - Great Britain, France, Italy and Japan, became the occupiers. In 1916, control of the Southern portion of the old Ottoman Empire was divided - Lebanon and Syria were assigned to France, and "Palestine" (today's Jordan, Israel and "West Bank") was mandated to Great Britain. The inhabitants of "Palestine" at this time were Jews, Christian Arabs, a number of nomadic warring tribes (based upon extended families), Druze and Bedouin. That was it. No infrastructure, no factories, no highways, no schools, no trains, no airports. Nothing. Just a lot of sand and swamps and rocks and thistles, plus few assorted settlements of Jews who had lived here for centuries, and early Kibbutzim, started by the Jewish refugees from Eastern Europe. At this time, NO other peoples had EVER established a national homeland in "Palestine" since the Jews had done it 5,000 years before. Even the electricity supply in Israel today, for example, was put in by the British in the early 1900's. The 'Palestinians' as a nation of Moslems, were a creation of Egyptian-born Yasser Arafat in 1964, with the main goal of destroying the Jewish people living in the Land of Israel. - still the defined goal of Hamas, today. In 1923, the British divided the "Palestine" portion of the Ottoman Empire into two administrative districts; Jews would be permitted to settle the 27.8% of the land west of the Jordan River creating a Jewish Palestinian National Homeland, whilst 72.2% was allocated to form an Arab Palestinian nation called Trans-Jordan (meaning "across the Jordan River"). This territory east of the Jordan River was given to Emir Abdullah (from Hejaz, now Saudi Arabia) who was not even an Arab-"Palestinian!" Problems arose, because Jordan & Lebanon & Egypt abrogated their responsibilities to the Palestinian Arabs that were living on the Lands - contrary to the agreements that were made with them in 1923. In 1946, Trans-Jordan was again renamed simply Jordan. In other words, the Eastern 72.2% of what was Palestine was renamed twice, in effect, erasing all connection to the name "Palestine!" The bottom line is that THE PALESTINIAN ARABS WERE ALLOCATED AN "ARAB PALESTINIAN" HOMELAND, in what is now Jordan. The remaining 27.2% of Palestine (now west of the Jordan River) was to be the "Jewish Palestinian" homeland. Encouraged by growing Arab nationalism throughout the Middle East, the Arabs of that remaining Palestinian territory west of the Jordan River, started to launch attacks upon the Jewish Palestinians in an effort to drive them out. The British at first tried to maintain order but soon (due to the large oil deposits being discovered throughout the Arab Middle East) turned a blind eye. It became clear to the Palestinian Jews that to survive, they must fight the Arabs, and drive out the British. In 1947, the UN passed Resolution 181, known as the Partition Plan, intended to divide the remaining 27.2% of Palestine into a Jewish Palestinian State and a SECOND Arab Palestinian State (Trans-Jordan being the first) based upon population concentrations. These were to be the Gaza Strip plus Judea-Samaria - today termed the "West Bank" of the Jordan River). The Jewish Palestinians accepted…..... the Arab Palestinians rejected - because they wanted all of the land, both East AND West of the Jordan River - and to get rid of all the Jews. In doing this, the General Assembly of the UN violated the League of the Nations' Mandate for Palestine in that it granted political rights to the Arabs in Western Palestine - yet, ironically, the Jews accepted the plan, while the Arabs worked to prevent it. On May 14, 1948 the Palestinian Jews declared their own State of Israel and became "Israelis." The next day, SEVEN neighbouring Arab armies, Egypt, Jordan, Syria, Lebanon, Saudi Arabia, Iraq and Yemen, invaded Israel. They encouraged most of the Arabs living within the boundaries of the 'newly declared' Israel, to leave, in order to facilitate the slaughter of the Jews -promising that they would be given all Jewish property after the 'victorious Arab armies' won the war. 70% of the Palestinian Arabs who left in 1948 – perhaps 300,000 to 400,000 of them – never even saw an Israeli soldier! They did not flee because they feared Jewish retaliation, but because they determined that while they were gone the Jews would be exterminated, and they would return afterwards to inherit those nice Jewish properties, built with Jewish money from overseas. They guessed wrong; and the Palestinian Arabs are still tortured by the shame of their flight. Their shame is so great because in their eyes running from Jews was like running from women. The result of the 1948 - 1949 Israeli War of Independence was that the almost-created second Palestinian Arab State was gobbled up by (1) Egypt (occupying the Gaza Strip) and by (2) Trans-Jordan (occupying Judea-Samaria (today termed the "West Bank" of the Jordan River). During 1950, Trans-Jordan merged the West Bank territory into itself and granted the 'Palestinian Arabs' living there Jordanian citizenship. Since Trans-Jordan was then no longer confined to one side of the Jordan River, it renamed itself simply "Jordan". So, the Arabs of Palestine ended up with nearly 85% of the original territory of Palestine... called Jordan but in reality their Arab "Palestinian state. From 1949 - 1967 When Egypt occupied Gaza in 1949, and Jordan occupied the West Bank and Jerusalem in 1949, no effort was ever made by Egypt or Jordan to support the Palestinian Arabs to develop their own autonomy. Nevertheless, Israel is being expected to now provide these same Arabs with their own country when their fellow Arabs failed to do so!!! The Israeli Prime Minister, Ariel Sharon expelled Jews from Gaza in September 2005. They left behind thriving agricultural businesses, schools, highways and beautiful homes. The Gazans turned it all to rubble or missile launching pads within days. According to sources in Ramallah, Qatar has been donating millions of dollars per month to help relieve the poverty suffered by Gaza residents – but Hamas have stolen much of it to buy advanced weaponry - is this moral? tuddy: I'm curious about your response: why DO people have to wait at checkpoints, do you think? And exactly who is "walled in" & by whom? Isn't it true that an Egyptian minister said last week that any Gazans who attempt to break into Egypt will have their legs broken by the Egyptian police or army? Or Russia or China? Why the US? Don't we already support Israel enough? Otherwise what is the $3 billion in aid per year for? Another Starbucks in Jerusalem? I guess my point is, why doesn't Israel do more on trying to open up dialogue with ME nations? After all the perception remains, that they are the invaders in the region. So why not have an annual peace conference in Jerusalem sponsered by Israel with all other ME nations invited? And if nobody else shows up, so be it. What can I do if landlord will not attend a new tenant walk thru, or sign inspection sheet documenting flaws? The day after moving into a new rental, I noticed a few cosmetic and/or minor problems. I asked the landlords to complete a walk thru inspection with me, and provide a signature acknowledging these flaws existed before I moved into the unit. Three weeks have passed, and the owners have cancelled two appointments, not returned my calls, or come by to see the rental. So I mailed a copy of my notarized inspection report, requesting signature acceptance, along with photos. I explained they do not have to fix, repair, or clean anything. I just want them to acknowledge these issues to avoid having money deducted from my security deposit in the future. I'm sure a few years from now, they won't remember a cabinet was chipped, tile broken, and other small problems. Although my rent check was cashed, I have not heard from them. Is the notarized letter, photos, and return signature enough? I really like the owners, and I'm surprised they are being so evasive about this. Very strange. P.S. All major things in the house work fine. It's just minor cosmetic issues that concern me, because those are usually what landlord's "could" use to retain security deposits in the future.

In most of Europe, ID cards are a non-issue (whether or not they are used). In Britain, they are a huge issue. When Tony Blair said we must have them, this divided the opposition: Michael Howard, an authoritarian, agreed vehemently with Blair, but was forced to back down by the more libertarian majority in his shadow cabinet. This exposed the Tories as divided, and Labour duly won the 2005 election. An Israeli attack on Iranian nuclear sites looks "unavoidable" given the apparent failure of sanctions to deny Tehran technology with bomb-making potential, one of Prime Minister Ehud Olmert's deputies said on Friday. "If Iran continues with its program for developing nuclear weapons, we will attack it. The sanctions are ineffective," Transport Minister Shaul Mofaz told the mass-circulation Yedioth Ahronoth newspaper. "Attacking Iran, in order to stop its nuclear plans, will be unavoidable," said the former army chief who has also been defense minister. It was the most explicit threat yet against Iran from a member of Olmert's government, which, like the Bush administration, has preferred to hint at force as a last resort should U.N. Security Council sanctions be deemed a dead end. Iran, which denies seeking nuclear weapons, has defied Western pressure to abandon its uranium enrichment projects. The leadership in Tehran has also threatened to retaliate against Israel -- believed to have the Middle East's only atomic arsenal -- and U.S. targets in the Gulf for any attack on Iranian turf. Mofaz also said in the interview that Iranian President Mahmoud Ahmadinejad, who has called for Israel to be wiped off the map, "would disappear before Israel does." The sources pointed out that Israel had asked the USA to approve the plan, which was sanctioned only a few days ago. They affirmed that president George Bush had agreed to the plan on condition that the assassination would take place after his visit to Israel, which is expected in mid January. We are repeatedly lectured that only a very small minority of Muslims are troublemakers who are giving the peaceful masses of Muslims a bad name. We are also informed that the terrorists, who happened to be Muslims, are the disaffected and the young. And not to worry, since as the fire of youth turns to ashes of old age the rebellious will mellow, as they always have. With heavy assurances like this, coming from so many know-it-all authoritative figures, we can sleep soundly without the aid of sleeping pills. After all, people reason that these pundits are “experts” whose job is to know and tell it like it is. Those who voice contrary views must be a bunch of racist, alarmist hate mongers. Who is right? Wouldn’t be more prudent to let the facts settle the matter, rather than blindly accepting either position? Of course it would, except for one huge problem. In the face of threats, people tend to go to the mind’s medicine cabinet and take a few denial and rationalization pills, in the same way that it is the aspirin bottle they turn to when a headache strikes. Why not? We are the Easy Species. We love effortless, quick and simple solutions. And that’s not invariably bad. It has given us all kinds of labor and time saving devices. Yet, the Islam problem is very real and deadly. Neither the pronouncements of the experts, nor the tranquilizing pills of the mind can make it go away. It is here and it shows every sign of imposing itself on us.
