The police stole one of these from me today, stating it was illegal?

http://www.farbgel.com/ Approved by the home office as a safe means of defence, it does no harm. Who do you believe, the police, or Farb, or the home office? Have already contacted the police station, am intending to gather all the evidence needed to ion form them of when I write the initialo complaint. I am not spaming, you cannot buy individual ones direct from this site, and the fact that police don't accept their legality, is no reason to buy them. Actually the officer REFUSED to give me a receipt, he doesn't even know the basics of law, if anyone takes something from someone else, they canm demand a receipt. I got a receipt when I made a charge of theft by the officer. The police knew I had it, because in making my enquiries, about people using their phone camera in dangerous situations, it came into the discussion, and at their request, I showed it to them. Police have seen it before, but they had the sense to check it was legal, and give it back. It could be used illegally, but I have had this for years, without ever using it. If I ever used it illegally I would be commiting an assault, but in the case of me being attacked, this spray would do not harm to them, but could protect me. The police cannot stop me carrying perfume, that would be more dangerous in the culprits eyes, than this harmless spray.

Contact the Police station where the officers are based and ask them to justify the confiscation if they removed it from you they must have given you some paper work or taken your details so follow it up and demand an explanation. To many police and people in authority put their own interpretation on the Law instead of the actual requirements of the law.
  4. according to the website it is legal in the UK, they dont mention if it is in the USA or not. I would assume that it has not been approved in the USA
  5. Technically it does fall under the legislation of an item which propels a substance which causes an irritation. ITs not a section 5 Firearm like pepper sprays, but you still arent allowed to have one as directed by secratary of state. So the company which pedal the spray are not thinking of the right legislation.... or more likely they are ignoring the little used or known legislation which makes this item illegal to possess in a public place.

  10. How did the policeman know you had it? Were you messing about with it? Were you showing it off? Threatening someone? Were you searched? If so, why were you searched. I cannot believe the policeman just stole it for no reason.
  11. Well, UK's is f*d up with their laws, anything that can be used or is intended to as a weapon is illegal. So even if it is a color spray if you carry it as a (defensive) weapon it's illegal. If you carry a crowbar as a working tool nicely sealed you can get away with it.

You are entitled to self-defense,,,and if the police took it, then they "have" to give you a receipt for seized property, go see their supervisor or Internal Affairs,,,unless like in Canada you cannot have pepper spray or mace , but you can carry Bear Spray,,because you never know when you might be in downtown Toronto going to the CN Tower, and get attacked by a pack of bears,,,,,,,,,

Personally I do not believe that this gel is covered by section 5 of the Firearms Act (prohibited weapons), which covers CS gas, mace pepper spray etc. Likewise I query it being an offencive weapon. It is not stated as an offencive weapon per se, however the question is whether it is made or adapted for causing injury. My own thoughts are it is made as a distraction to allow you to get away. However if the officer thought that it was either of the above (prohibited weapon or offencive weapon) then why did he/she not arrest you. They could have interviewed you and sought advice as to whether it was legal or not. The Forensic Science Service could analyse the contents and classify whether it was illegal or not. It would appear that what the officer did was a bit of a half way house.
  18. they don't want us protecting our selves. crime is Britain's biggest and most profitable business. they cant have you taking away their customers. they want em out on the streets committing more crime and bringing in more money, as is evident by their sentencing. the legal system is as corrupt as it could get. and is no way!! set up with the public's interest in mind.

In the UK if you have anything to defend yourself it is usually classed as an offensive weapon if you direct it into peoples eyes than it obviously does do harm or it would be useless even though it may be temporary,The Home office does not approve this as a means o self defence.Yes a bottle of perfume could be taken from you as could anything else if the police can prove an intent that you had it to cause harm or injury to any other person.
